Terms and Conditions of Sale

Preamble
In accordance with Article R211.4 of the French Tourism Code, these General Terms and Conditions of Sale, hereinafter referred to as "GTC", are intended to inform the clients of SAS AIR LAGON, with a share capital of 15,000 euros, registered at 46 Rue Général de Gaulle, 97436 Saint-Leu, Reunion Island, hereinafter referred to as "AIR LAGON", prior to the conclusion of a sale.
In accordance with Article L211.9 of the French Tourism Code, this pre-contractual information shall form an integral part of the contract and may only be modified by express agreement between the parties.
These General Terms and Conditions of Sale are available on the AIR LAGON website and communicated to the client in every electronic correspondence.
Article 1 — General Provisions
These general terms and conditions define the rights and obligations of the parties in the context of the marketing by AIR LAGON of tourist services by correspondence, at the AIR LAGON counter, through its website and its group service, to persons having the status of consumers or non-professionals within the meaning of the Consumer Code and having the legal capacity to contract (hereinafter, "the Client(s)").
These general terms and conditions apply to the exclusion of all other conditions. They concern only services provided in France for Clients located on French territory.
For the services offered by AIR LAGON, AIR LAGON acts solely as agent of the service provider under whose responsibility the service is provided. Only the sale of the ticket to the Client is subject to these general terms and conditions. The execution of the service is subject to the provider's own conditions.
Article 2 — Booking, Deposit and Balance
Booking: The client submits a booking request electronically or by telephone. Subject to the availability of AIR LAGON's contracted providers, a proposal is sent to the Client electronically as soon as possible. The proposal is valid for 8 hours, unless otherwise indicated. Failing cancellation by the Client within this period, the option taken with the providers is confirmed. Orders or bookings are firm and final once the 8-hour period has expired without the Client cancelling.
Deposit: To secure AIR LAGON's service providers, the booking may require a deposit not exceeding 50% of the total price. If proof of payment is not provided within 24 hours, AIR LAGON may consider non-payment as notification of cancellation by the Client.
Balance payment: The balance must be paid no later than the day of the service. The final number of participants must be confirmed at least 2 days before the service date. If fewer participants show up, no refund will be issued. If more participants arrive, the price will be adjusted accordingly.
Article 3 — Service Delivery
Client delay: In case of group delay, the service is shortened accordingly or extended subject to provider availability. Beyond 15 minutes of waiting, the provider is released from obligations, and the full price remains due.
Provider delay: The group waits for the provider for the first half hour. If the service cannot be extended, a proportional reduction will apply. Beyond half an hour of delay, the group may cancel and receive a full refund.
Force majeure: All circumstances beyond the control of the parties preventing normal performance are considered grounds for exemption. This includes transport blockages, earthquakes, fires, storms, floods, lightning, and telecommunications network failures.
Article 4 — Pricing
Products are invoiced based on rates in effect at the time of order. Prices shown in euros include all taxes (TTC). Prices include the applicable VAT rate at the date of booking; any VAT rate change will be automatically reflected.
Any service not included in the contract will be invoiced separately. Any service not consumed due to the client (delay, etc.) remains due and will not be refunded.
The Client guarantees that they have the necessary authorizations for the chosen payment method. AIR LAGON reserves the right to suspend any booking in case of payment authorization refusal.
Article 5 — Cancellation by the Client
Any cancellation must be notified in writing (email or postal letter) to AIR LAGON.
More than 2 days before the service: Full refund of sums received, automatically processed within 14 days from receipt of the cancellation request, regardless of whether the Client expressly requests it.
Less than 2 days before the service: The full price of the reserved services is due. AIR LAGON may, subject to availability, propose a rescheduled date as an alternative to retention of the funds.
Cancellation by AIR LAGON (weather, safety): If AIR LAGON cancels for safety or weather reasons, the Client receives a full refund within 14 days, with no fee.
Article 6 — Modification and Interruption
Any modification to the service characteristics (number of people, meeting point, times, etc.) requires prior agreement with AIR LAGON and is subject to provider availability.
In case of service interruption by the client, no refund will be issued. The client must arrive at the agreed date and time shown on the exchange voucher.
AIR LAGON may unilaterally make minor modifications to the contract after its formation, provided the Client is informed promptly. For significant modifications affecting an essential element (such as a price increase exceeding 10%), the Client may accept the modification or terminate the contract without penalty.
Article 7 — Insurance
The Client is responsible for all damages resulting from their actions. Clients are advised to take out a personal liability insurance policy.
Article 8 — Right of Withdrawal
For distance bookings, the Client generally has a 14-day cooling-off period from the conclusion of the contract. To withdraw, the Client must send an email to AIR LAGON specifying the cancelled booking number. AIR LAGON will refund within 14 days of the withdrawal exercise.
Exception: Article L221-28 of the French Consumer Code provides that the right of withdrawal does not apply to leisure activity contracts that must be provided at a specific date or period. AIR LAGON invokes this exception for all services falling within this scope.
Article 9 — Warranties
AIR LAGON guarantees the conformity of services to the contract, in accordance with Articles L.217-11 et seq. of the French Consumer Code. Any defects or non-conformities must be reported to AIR LAGON as soon as possible. AIR LAGON's warranty is limited to refunding the amounts actually paid by the Client.
Article 10 — Contract Transfer
In accordance with Articles L211-11 and R211-7 of the French Tourism Code, the Client may, as long as the contract has produced no effect, at the latest 2 days before the start of the service, transfer the contract to another person who meets all applicable conditions. The Client and the transferee are jointly liable for the remaining balance and any additional costs.
Article 11 — Liability
AIR LAGON shall not be held liable for non-performance of the contract in cases of force majeure, disruption, strike, flood, or fire.
It is the Client's responsibility to verify that the personal information provided during booking is accurate and complete.
In accordance with Article L211-16 of the French Tourism Code, AIR LAGON is fully liable for the execution of services provided under the contract but may be exempt in cases where the damage is attributable to the Client or to an unforeseeable third party. Compensation shall not exceed three times the total price of the tourist service, except in cases of bodily injury or intentional damage.
Article 12 — Intellectual Property
All technical documents, products, drawings, and photographs provided to buyers or featured on the AIR LAGON website remain the exclusive property of AIR LAGON and its partners. Clients agree not to make any use of these documents that could infringe upon the intellectual property rights of AIR LAGON and its partners.
Article 13 — Personal Data Protection
Personal data is collected by AIR LAGON for administrative and commercial order management. This information is stored for security and commercial purposes only internally. Data is hosted within the European Union; certain technical providers (content delivery network) may however operate outside the European Union, under the EU-US Data Privacy Framework or standard contractual clauses.
In accordance with applicable regulations, the Client has the right to access, rectify, port, and erase their data, or to limit processing. To exercise these rights, contact the GDPR officer at: [email protected].
In case of difficulty, the Client may file a complaint with the CNIL (French Data Protection Authority) or any other competent authority.
Articles 14 to 18 — General Provisions
Partial invalidity (Art. 14): If any provision of these terms is held invalid, the remaining provisions shall retain their full force and effect.
Non-waiver (Art. 15): Failure by either party to enforce any provision shall not be construed as a waiver of that provision.
Headings (Art. 16): In case of interpretation difficulty between headings and clauses, headings shall be deemed non-existent.
Language (Art. 17): These general terms and conditions are written in French. In case of translation into one or more foreign languages, only the French text shall prevail in case of dispute.
Disputes (Art. 18): Any complaint must be reported to AIR LAGON promptly. The Client may resort to conventional mediation with the Consumer Mediation Commission. These general terms are subject to French law. In case of dispute, the Client should first contact AIR LAGON for an amicable resolution.
